Two experienced defense attorneys, Andrea Silk and Brandon Weinstein, both Partners with Gallo Vitucci Klar LLP presented at the 2026 Summer Membership Meeting on the key pitfalls reinsurance carriers encounter when handling personal injury claims. The presenters began by highlighting the danger of late severity recognition, when reinsurers or counsel don’t recognize the value of the claim until late in the life cycle, and cautioned against over-reliance on early reserves or cedent assessment. The panel also addressed the risks of excessive deference to primary carriers under “follow the fortunes” assumptions, stressing the value of claim cooperation clauses, periodic file reviews, and escalation protocols. The panel noted the need for rigorous documentation around coverage positions, including trigger disputes, allocation questions, and reservation of rights analysis, where informal communications can expose reinsurers.
The session also focused on structural and financial blind spots that erode reinsurance profitability. The panelists advised reinsurers to assess their cases against nuclear verdict scenarios and monitor plaintiff attorney trends. The presenters specifically flagged how higher layers can be unexpectedly reached through defense cost erosion, stacked policies, umbrella drop-down provisions, and emphasized the need to audit litigation strategy and settlement potential regularly.
The panelists ended the session with a forward-looking review of emerging injury theories and trends reshaping the personal injury landscape, including evolving exposures in PFAS bodily injury, talc litigation, concussion/CTE claims, rideshare liability, data centers, and autonomous vehicle liability that present frequency and severity patterns with little historical precedent. The presenters noted plaintiff-side tactics gaining traction, as well as the bad faith risks that arise when limit demands are mishandled or poorly documented. The overarching takeaway was that reinsurers should engage in proactive monitoring and active documentation of their claims to handle this environment.
