Daisy Khambatta and Bevin Carroll, both Partners with Kennedys opened the program with a discussion on the impact of litigation funding on the U.S. insurance market, examining how third-party litigation funding continues to reshape claims exposure and litigation strategy. Second, Elaine Whiteman Klinger, a Partner and Karen Moran, Special Counsel, of Kennedys, along with Andrea Gianetta, SVP Group Litigation Director at Enstar and Erika Lopes-McLeman, a Partner with Dentons, discussed emerging claims associated with ultra-processed food, social media, PFAS, and Roundup. This engaging panel walked through the latest wave of mass-tort and emerging liability exposures and what they mean for carriers and reinsurers.
Next, Peter Kelly of FTI Consulting and Noella Kemigisa of the Bermuda Monetary Authority led a discussion on current regulatory developments affecting the (re)insurance market. This session generated significant audience engagement, with numerous questions from attendees on regulatory compliance and enforcement trends.
Finally, Martha Conlin, a Partner with Troutman Pepper Locke, Dan Waterloo of Illinois Institute of Technology, and John LaBarbera, a Partner of Kennedys closed out the program with a deep dive into both the technical underpinnings and legal implications of AI adoption in insurance. This session sparked particularly active discussion, with attendees raising novel questions around confidentiality and legal privilege, reflecting how quickly this area is evolving and how much uncertainty remains in the market.
