This panel addressed current trends in arbitration, including an introduction from the in-house representatives designed to provide “the view from the trenches.” The discussion included lessons to be learned from trends in arbitrations, including statistics about the available pool of arbitrators and the increasing expense associated with arbitration.
The panel next discussed recent case law on arbitration issues, including two U.S. Supreme Court cases. The topics addressed in the 2023 and 2024 decisions included:

- Arbitrator non-disclosures
- Fraud & misconduct
- Confidentiality, finality & functus officio
- Arbitrability
Finally, the panel provided some insight into various updates to arbitration rules, guidelines, contracts and laws. This portion of the discussion focused on how the industry can make the arbitration process faster, fairer, and more transparent. AIRROC Board Member Judy Harnadek provided an overview and the benefits of the new AIRROC Dispute Resolution Procedure. The panel ended with a brief discussion on changes in the international guidelines, including those from the International Bar Association and the pending legislation in the UK.
